For this reason many people would certainly settle for this than go through the rougher battle of having an annulment. The only tough thing with this procedure is when it involves infant custody. Usually, the fight for custody is what makes the process hard.

An annulment, conversely, declares the marriage null and void. In declaring this, the marriage is going to be declared to have not taken place at all! Normally, the terms that may make an annulment possible are harder like for instance, marriage when one is underage and there is no consent from the parents for the marriage or if the marriage took place under false pretenses. Generally, these conditions include falsehoods, non-declaration of legal commitments or not adhering to the legal terms of marriage.

Legal separation can be regarded as a notch lower than divorce when it comes to the removal of all legal obligations and duties. It’s however harder to obtain one. In legal separation, the partners agrees to live apart but will continue to support one another and have legal commitments to each other. Just like maried people, their assets are still bound together. They are also not permitted to marry another person until they have a divorce or an annulment.

But for many individuals, there is really no need for these legal commitments to continue. Thus, most Americans opt for divorce. One cannot really blame them. It’s easier and faster with less the hassle.
